As the employment relation between employers and employees develops, each of the parties has duties related to the relationship. Employees have rights based upon several theories under the law. An employer may not single out and treat an employee differently based upon a protected characteristic; such as race, religion, color, national origin, disability and several other legally protected characteristics.Further, an employer may not retaliate against an employee for an issue related to public policy, such as service on jury duty. Lastly, an employer may not retaliate against an employee’s privacy, to use reasonable diligence in their hiring and retention practices and to honor their own policies and procedures.If you have been singled out and treated differently, held to different standards, and subjected to a hostile and offensive environment because of a protected characteristic, or retaliated against, you have the rights and the Law Office of Bowman & Associates, APC is here for your advocacy.

Why Bowman and Associates?

Under State and Federal law an employee cannot be singled out and treated differently based on a protective characteristic such as their race, religion, national origin, disability, etc.

Employees can bring a wrongful termination claim and possibly a lawsuit for damages against their employer.

Employees have the right to be treated with reasonable curtesy, dignity and respect. Organizations that fail to protect employees and allow abuse expose themselves to claims such as discrimination and emotional distress damages.
California is an “at will” state and employers do not have a legal obligation to provide a reason for termination.

Exceptional employers will work with employees to create a beneficial environment. Sometimes employers that do not provide a reason do so because they cannot substantiate a valid legal reason.

Signing a termination or reprimand does not automatically mean that the employee agrees with the contents stated within the document. Sometimes it is good to not only sign the document, but to write language such as, “I disagree” or “I object” next to your signature.

Under recent California legislation employees are entitled to a minimum of 24 hours of sick leave per calendar year. The rules about sick leave are more liberal under the new legislation and allow sick leave for personal and family member’s health related issues. Employees have a legal remedy if they have been terminated or retaliated against for taking sick leave.
Employees not properly paid overtime can go back at least 3 years from the date of the employees claim. It is important to keep accurate records of overtime hours worked to substantiate any claim.
